Terms of use

Draft: this text contains highlighted items that the service owner or their counsel must complete. It has not been validated and must not be published as it stands.

Effective date: [TO COMPLETE: date]

These terms describe the rules for using Kwata TV. The service is published by [TO COMPLETE: name or company name of the publisher] (see the legal notice).

[TO COMPLETE: how the user accepts these terms. Today, account creation and payment show the line "By continuing, you accept the terms of use and the privacy policy", with their links, and no checkbox; counsel says whether that counts as acceptance or a checkbox is needed]

The service

Kwata TV lets you watch, from a browser, a selection of live television channels chosen by the publisher, for a paid or free access period. It is aimed at users in any of the countries where payment is open (the list is in the offer below and on the payment screen), in French or English.

The programmes belong to their broadcasters and rights holders: the service does not own them. [TO COMPLETE: broadcast authorisations the publisher holds, to describe with counsel]

Your account

  • You create an account with an email address and a password. The address is not verified and the service never sends you an email or an SMS.
  • When you sign up, a recovery code is shown to you once. Write it down, photograph it or download it, and confirm it before your first payment: it is what lets you recover your account if you forget your password.
  • If you lose both your password and your code, support can help, but only if you have already paid (see Refunds and support).
  • Only one device is active at a time on an account. If you sign in from another device, the first one is signed out immediately.
  • You are responsible for keeping your password and your recovery code confidential, and for what is done with your account. Never share them, not even with support.
  • Minimum age: [TO COMPLETE: minimum age to use the service]

Paid access

The length of access is the same everywhere. The price depends on the country you choose to pay from and is set in that country's currency; it is shown on the payment page before every payment. The table below gives the current offer.

Length of access: 3 hours

  • FCFA 200: Cameroon, Gabon, Congo - Brazzaville
  • CDF 800: Congo - Kinshasa
  • KES 45: Kenya
  • RWF 520: Rwanda
  • SLE 8.50: Sierra Leone
  • UGX 1,400: Uganda
  • FCFA 200: Benin, Côte d’Ivoire, Senegal
  • ZMW 7: Zambia
  • There is no subscription and no automatic renewal: you pay when you want to.
  • Payment is made by Mobile Money, without leaving the site: a PIN request is sent to the number you entered, and you approve it on that phone. Check the number before you pay. The number must be a Mobile Money number from the country you chose, with one of the operators offered for that country. With some operators the PIN request does not appear by itself: the screen then tells you the code to dial on your phone. The access period starts once our server has checked with our payment provider that the payment is confirmed. A message shown on the screen is not enough on its own.
  • The price is set in your country's currency. It is not converted at the time of payment: the amount shown is the amount requested. Your Mobile Money operator may charge its own fees on top.
  • If you already have access in progress, the new period is added to the end of the current access. If your access has ended, it starts at confirmation, except during a free-access period: it then starts when the period ends.
  • If your operator confirms a payment late, after its waiting time has expired, access is still granted automatically, once only.
  • The access period runs continuously: it keeps running even if you are not watching, or if no channel is available at that moment (except during a free-access period, when paid time is paused).

Free-access periods

The publisher may open free-access periods on dates announced on the site, Cameroon time. During a period, watching needs neither an account nor a payment, and any paid time in progress is paused: it resumes, intact, when the period ends. The period ends at the announced time, or earlier if the publisher ends it; watching then stops for anyone without paid time. [TO COMPLETE: any notice for an early end]

Using the service

  • An account watches only one channel at a time, on one device. Opening another channel or another device closes the previous playback.
  • The number of channels that can be watched at the same time is limited. When the limit is reached, a channel may show as unavailable.
  • You agree to use the service for your personal use. In particular you must not share your account, copy, rebroadcast or resell the channels, bypass the technical protections, use robots to create accounts or collect the streams, or disrupt how the service works.

[TO COMPLETE: final rules of use and penalties, to be validated by counsel]

Channel availability

The channels offered are chosen by the publisher and may change: a channel may be added, removed or be briefly unavailable, for example when its source is not answering. Picture quality adapts to your connection, and video uses data: the player offers a "data saver" mode.

The service does not guarantee continuous availability. [TO COMPLETE: any availability commitments and the effect of an interruption on paid access]

Payments and refunds

Payment problems, double charges and refund requests are handled as described on the Refunds and support page.

Suspension and closure

The publisher may block or close an account if these terms are not respected or in case of abuse (for example accounts created in bulk or a shared account). [TO COMPLETE: conditions, any notice, and what happens to the remaining access period]

Liability

[TO COMPLETE: limits of the publisher's liability, to be drafted with counsel under the applicable law]

Personal data

The data the service records, how long it is kept, the cookies and your rights are described in the privacy notice.

Governing law and disputes

[TO COMPLETE: governing law, competent court and any out-of-court dispute resolution]

Changes to the terms

The publisher may change these terms. The effective date is at the top of the page. [TO COMPLETE: how users are told about an important change]
